Rubix Drums Ltd – Terms & Conditions of Sale
Please read these terms and conditions carefully before using this website and making a purchase. By accessing this website and/or placing an order, you agree to be bound by the following terms and conditions.
1. Definitions
1.1 Rubix Drums Ltd – Unit 3 Belvue Road, UB5 5QQ London, also referred to as "we", "us", or "our".
1.2 Goods – One or more of the individual items available for purchase on the Rubix Drums Ltd website.
1.3 The Customer – The user or end beneficiary of the goods and services offered by Rubix Drums Ltd, also referred to as "you".
1.4 Force Majeure – Any event beyond Rubix Drums Ltd’s reasonable control that prevents the performance of its obligations, including government regulations, fire, flood, terrorism, industrial disputes, or any other unforeseeable event.
2. The Contract Between Us
2.1 Any contract for purchases made through the website will be with Rubix Drums Ltd.
2.2 Rubix Drums Ltd must receive full payment for the goods ordered before your order can be accepted, and the contract is formed.
2.3 Rubix Drums Ltd’s acceptance of your order forms a legally binding contract, and any terms imposed by you in your order will not form part of the contract.
2.4 Rubix Drums Ltd is entitled to withdraw from any contract in case of errors or inaccuracies related to the goods on the website. If there is an error with the advertised price, we will contact you as soon as possible to inform you of the correct price and ask whether you wish to continue or cancel the order.
3. General
3.1 These terms do not affect the customer’s statutory rights.
3.2 A contract is only formed between Rubix Drums Ltd and the customer once Rubix Drums Ltd accepts an order.
3.3 All prices quoted are in pounds sterling and exclude applicable UK VAT unless stated otherwise.
3.4 Prices listed on the website are correct at the time of posting but may change. Errors and omissions excepted.
3.5 All products are subject to availability.
3.6 Products and specifications may change over time, and items may become discontinued.
3.7 If any provision in this agreement is held to be invalid, it will be severed from the agreement, and the remaining provisions will remain in force.
3.8 Any variation of this agreement must be in writing and signed by a duly authorized Rubix Drums Ltd director.
3.9 These terms are governed by the laws of England, and the parties submit to the exclusive jurisdiction of the English courts.
3.10 Rubix Drums Ltd reserves the right to change or amend these terms without prior notice.
3.11 Rubix Drums Ltd is not responsible for external websites linked to Rubix Drums Ltd.
4. Prices
4.1 Prices listed on the Rubix Drums Ltd site are correct at the time of posting (errors and omissions excepted).
4.2 Rubix Drums Ltd reserves the right to amend prices at any time.
4.3 All quoted prices include UK VAT at the current rate.
4.4 All quoted delivery charges include UK VAT at the current rate.
5. Orders
5.1 Clear instructions are provided on the website for navigating and placing an order.
5.2 Once we receive your order, we perform a pre-authorisation check on your payment card. Payment is only debited once authorised, and goods will be dispatched subject to availability.
5.3 All orders are subject to acceptance and availability of the goods ordered. If Rubix Drums Ltd has insufficient stock, we will notify you. If a short delay is acceptable, the card will remain debited and goods shipped when in stock. If the new lead time is unacceptable, any sum debited will be refunded immediately.
5.4 The customer must ensure that:

All details provided for the purpose of purchasing goods are correct.

The credit or debit card used belongs to the customer and is registered to the customer’s address.

There are sufficient funds or credit facilities available to cover the cost of goods ordered.
6. Methods of Payment
6.1 Rubix Drums Ltd accepts all major credit or debit cards (except American Express or Diners Club). Direct bank transfers may be accepted by prior arrangement.
6.2 Credit card transactions will require the expiry date, card number, and possibly other security questions. Goods can only be sent to the cardholder’s verified address.
6.3 International Bank Transfers: Any fees, currency conversion losses, or charges incurred during international refunds will be deducted from the refunded amount.
6.4 PayPal Terms and Conditions:

Payments must fully clear before refunds or order processing.

Refunds are processed only after PayPal releases funds.

Delays caused by PayPal are not Rubix Drums Ltd’s responsibility.

PayPal transactions incur an additional 4% charge.
7. Delivery and Title
7.1 We strive to dispatch products in stock within 5 working days from order, but this is an estimate.
7.2 Any stated time or date for delivery is an estimate only.
7.3 Rubix Drums Ltd is not liable for consequential loss caused by delivery delays.
7.4 Notification of shortages or damage must be made in writing within 7 days of receipt.
7.5 Delivery is deemed complete when goods are delivered to the nominated address; risk passes to the customer at that point.
7.6 Title of goods passes only when payment is received in full and cleared.
8. Product Specification
8.1 Goods may be subject to minor variations in dimensions and specifications.
8.2 If we cannot supply the ordered goods, we may offer equal or superior alternatives. If unacceptable, the order may be cancelled and refunded.
9. Cancellation, Returns, and Refunds
9.1 All products are warranted to be free from defects and fit for their designed purpose.
9.2 Products are not sold on a trial basis; returns are based on suitability.
9.3 Customers may return goods within 7 days of delivery or collection. Refunds or credit notes may incur a restocking fee of 15% (25% if packaging is broken or item used). Banking or platform fees (e.g., PayPal, Reverb) will be deducted.
9.4 Pre-recorded media must be sealed for a refund.
9.5 Free gifts or promotional materials must also be returned.
9.6 Goods must be returned with original receipt/invoice and paperwork.
9.7 Once returned goods are checked for damage, refunds will be issued using the original payment method unless otherwise arranged.
9.8 The customer is responsible for returning goods personally or via registered post.
9.9 Rubix Drums Ltd is not responsible for goods lost during return shipping.
9.10 Rubix Drums Ltd may refuse a refund for damaged returned packages.
10. Secondhand Goods – Strictly Non-Refundable and Non-Returnable
10.1 All secondhand (used) goods sold by Rubix Drums Ltd are strictly non-refundable and non-returnable.
10.2 All secondhand items are sold as seen, as inspected, and as described at the point of sale. By completing the purchase, the buyer confirms acceptance of the item in its existing condition, including any wear, cosmetic marks, ageing, or other characteristics consistent with secondhand goods.
10.3 In accordance with the Consumer Rights Act 2015, secondhand goods are required only to be:

Fit for purpose where such purpose has been expressly agreed.
10.4 Where a secondhand item meets the above statutory requirements at the time of sale, no right to cancellation, return, exchange, or refund shall apply.
10.5 Orders for secondhand goods may only be cancelled prior to dispatch. Once an item has been shipped, collected, or otherwise left the premises, the sale is final, binding, and cannot be cancelled, reversed, returned, or exchanged.
10.6 Upon collection, the purchaser may be required to sign a collection receipt confirming the item has been inspected, received in satisfactory condition, and accepted in full. Failure to inspect prior to leaving the premises does not affect acceptance or finality of the sale.
11. Backorders
11.1 If an item is out of stock, the customer will be informed. Alternatives may be suggested, or the customer can wait or request a refund. Backordered items will not be charged until dispatched.
12. Force Majeure
12.1 Rubix Drums Ltd shall not be in breach of contract if unable to perform due to force majeure events.
13. Errors and Omissions
13.1 Rubix Drums Ltd makes every effort to ensure prices and descriptions are correct. In the event of errors, liability is limited to a refund of any payment made.
14. Intellectual Property
14.1 Rubix Drums Ltd owns all copyright, trademarks, and intellectual property on this website.
14.2 Materials may be used for personal, non-commercial purposes only.
14.3 Any other use or reproduction is prohibited.
15. Changes to This Agreement
15.1 Rubix Drums Ltd reserves the right to make changes to the website, policies, and terms and conditions at any time.
15.2 If any provision is deemed invalid, it will be severed from the agreement, and the remaining provisions will remain valid.
16. International Logistics and Customs
16.1 International shipments may be subject to customs duties, import taxes, and other fees. These are the customer’s responsibility.
16.2 If a shipment is refused, undeliverable, or returned due to non-payment of fees, any costs incurred will be deducted from any refund issued.
16.3 Rubix Drums Ltd is not responsible for delays caused by customs processes.
