Terms and Conditions of Sale

Please read these terms and conditions carefully before using this website and making a purchase.

By accessing this website and/or placing an order, you agree to be bound by the following terms and conditions.


1. Definitions

  1. Rubix Drums Ltd: Unit 3 Belvue Road, UB5 5QQ London, also referred to as "we", "us", or "our" in these terms and conditions.

  2. Goods: Refers to one or more of the individual items available for purchase on the Rubix Drums Ltd website.

  3. The Customer: The user or end beneficiary of the goods and services offered by Rubix Drums Ltd, also referred to as "you".

  4. Force Majeure: Refers to any event beyond Rubix Drums Ltd’s reasonable control that prevents the performance of its obligations, such as government regulations, fire, flood, terrorism, industrial disputes, or any other unforeseeable event.


2. The Contract Between Us

A) Any contract for purchases made through the website will be with Rubix Drums Ltd.

B) Rubix Drums Ltd must receive the full payment for the goods ordered before your order can be accepted, and the contract is formed.

C) Rubix Drums Ltd’s acceptance of your order forms a legally binding contract, and any terms imposed by you in your order will not form part of the contract.

D) Rubix Drums Ltd is entitled to withdraw from any contract in case of errors or inaccuracies related to the goods on the website. If there is an error with the advertised price of the goods you’ve ordered, we will contact you as soon as possible via email to inform you of the correct price and ask whether you wish to continue with the order at the updated price or cancel it.


3. General

A) These terms do not affect the customer’s statutory rights.

B) A contract is only formed between Rubix Drums Ltd and the customer once Rubix Drums Ltd accepts an order.

C) All prices quoted are in pounds sterling and exclude the applicable UK VAT.

D) Prices listed on the website are correct at the time of posting but may change. Errors and omissions excepted, and Rubix Drums Ltd reserves the right to refuse any order.

E) All products are subject to availability.

F) Products and specifications may change over time, and items may become discontinued.

G) If any provision in this agreement is held to be invalid, it will be deemed severed from the agreement, and the remaining provisions will remain in force.

H) Any variation of this agreement must be in writing and signed by a duly authorized Rubix Drums Ltd director.

I) These terms and conditions are governed by the laws of England, and the parties submit to the exclusive jurisdiction of the English courts.

J) Rubix Drums Ltd reserves the right to change or amend these terms without prior notice.

K) Rubix Drums Ltd is not responsible for external websites linked to Rubix Drums Ltd.


4. Prices

A) Prices listed on the Rubix Drums Ltd site are correct at the time of posting (errors and omissions excepted).

B) Rubix Drums Ltd reserves the right to amend prices at any time.

C) All quoted prices include UK VAT at the current rate.

D) All quoted delivery charges include UK VAT at the current rate.


5. Orders

A) Clear instructions are provided on the website for navigating and placing an order.

B) Once we receive your order, we perform a pre-authorisation check on your payment card to ensure sufficient funds are available. The payment is only debited once authorised, and the goods will be dispatched subject to availability.

C) All orders are subject to acceptance and availability of the goods ordered. Rubix Drums Ltd is entitled to refuse any order placed at any time. If Rubix Drums Ltd has insufficient stock to supply the ordered goods, we will notify you as soon as possible. If a short delay prior to shipping is acceptable, then the card will remain debited and the goods will be shipped when in stock. If, however, the new quoted lead time is unacceptable, any sum debited by Rubix Drums Ltd from your credit card will be re-credited to your account. The refund will be made immediately. Rubix Drums Ltd will not be obliged to offer any additional compensation for disappointment suffered.

D) The customer must ensure that:

All details provided for the purpose of purchasing goods are correct.

  • The credit or debit card used to make a purchase from Rubix Drums Ltd is the customer’s own card, the card is registered to the customer’s address, and the customer is authorized to use the card.

  • There are sufficient funds or credit facilities available on the card to cover the cost of the goods ordered.


6. Methods of Payment

Rubix Drums Ltd accepts all major credit or debit cards (except American Express or Diners Club). We can also, by prior arrangement, accept direct bank transfer payments. Credit card transactions will require the expiry date as well as the card number and possibly other security questions. Goods can only be sent to the cardholder’s address, which is verified prior to dispatch.

PayPal Terms and Conditions:

By making a payment via PayPal, you agree to the following terms and conditions:

  • Payment Clearance: All payments made through PayPal must fully clear into our account before any refunds, exchanges, or order processing can take place. PayPal may place payments on hold, and we do not receive access to the funds until they are released by PayPal.

  • Refund Policy: Refunds will only be processed once the payment has cleared into our account. If your payment is on hold, we are unable to issue a refund until PayPal releases the funds to us.

  • Processing Times: The time it takes for PayPal to release payments varies. We are not responsible for any delays caused by PayPal’s policies or processes.

  • Disputes & Chargebacks: If a chargeback or dispute is initiated while funds are still on hold, we reserve the right to wait until the dispute is resolved before issuing any refunds or further action.

PayPal transactions shall incur an additional 4% charge.

By proceeding with your PayPal payment, you acknowledge and accept these terms.


7. Delivery and Title

A) We will strive to dispatch products in stock within 5 working days from the point of order but reserve the right to amend this time frame due to unforeseen circumstances.

B) Any time or date stated for delivery is an estimate only.

C) Rubix Drums Ltd makes every effort to dispatch goods within the stated time but does not accept liability or responsibility for any consequential loss caused to the customer.

D) Rubix Drums Ltd does not accept liability for shortages or damage to deliveries unless the customer notifies Rubix Drums Ltd of the shortage or damage in writing within 7 days of receipt of the delivery.

E) Delivery is deemed to have taken place when the goods are delivered to the customer’s nominated address, whereupon the risks of loss, breakage, damage, and all other risks shall pass to the customer.

F) Title of the goods does not pass to the customer until payment is received in full by Rubix Drums Ltd with cleared funds.


8. Product Specification

A) Rubix Drums Ltd makes every effort to supply the goods as advertised but reserves the right to supply goods subject to minor variations in actual dimensions and specifications.

B) If Rubix Drums Ltd cannot supply the goods ordered, Rubix Drums Ltd reserves the right to offer goods of equal or superior quality at no extra cost. If the customer does not wish to accept the alternative goods offered, they may cancel the order and receive a refund for any money paid.


9. Cancellation, Returns and Refunds

Rubix Drums Ltd is committed to providing high-quality products and service. However, if products are defective or unsuitable upon receipt, the following applies:

A) All products supplied are warranted to be free from defects in workmanship and materials and fit for their designed purpose.

B) Subject to the right of consumers to return goods for refund, Rubix Drums Ltd does not sell products on a trial basis. However, flexibility is provided for returns based on the suitability of the product purchased.

C) If the customer is unhappy with their purchase, they may return the goods within 7 days of delivery or collection. A refund or credit note will be issued, with a restocking fee of 15% (25% if the packaging is broken and the item cannot be resold). Any banking or platform fees (e.g., Reverb, PayPal fees) will also be deducted.

D) Pre-recorded video tapes and DVDs must be sealed in their original packaging for a refund.

E) Free gifts or other promotional materials received with the product must also be returned.

F) Goods must be accompanied by the original receipt/invoice and paperwork.

G) Once returned goods have been checked for damage, a credit for the value will be refunded using the same payment method as the original purchase unless arranged otherwise.

H) The customer is responsible for returning any products to Rubix Drums Ltd and should either return the goods personally or by registered post.

I) Rubix Drums Ltd is not responsible for goods lost or mislaid by third parties during return.

J) Rubix Drums Ltd cannot accept responsibility for damaged returned packages and reserves the right to refuse a refund if this occurs.


10. Backorders

If the requested item is out of stock, the customer will be informed. An alternative item may be suggested, or the customer can choose to wait for the item to come back in stock, or request a refund. Backordered items will not be charged until dispatched.


11. Force Majeure

Rubix Drums Ltd shall not be in breach of contract if it is unable to perform any obligation due to force majeure.


12. Errors and Omissions

Rubix Drums Ltd makes every effort to ensure that prices and descriptions are correct. However, if there is a shipping error, Rubix Drums Ltd can rescind the contract, and its liability will be limited to a refund of any payment made. If there is a pricing error, the customer may purchase the goods by paying the difference.


13. This Website

Rubix Drums Ltd owns the copyright, trademarks, and other intellectual property rights in all material on this website. You may only use, download, copy, or publish materials for personal, non-commercial use. Any other use or reproduction of the content is prohibited.


14. Changes to This Agreement

Rubix Drums Ltd reserves the right to make changes to our site, policies, and these terms and conditions at any time. If any provision is deemed invalid, it will be severed from the agreement, and the remaining provisions will remain valid.
